CORPORATION TAX DUE DATES AND REQUISITE AMOUNT

Preliminary Tax Payments for Accounting periods ending up to 2001
|
|
|
|
The Preliminary Tax payment must be a minimum of 90% of the tax payable for the period. It is due six months after the end of the period (but not later than the 28th of the month in which it is payable).

|
|
Preliminary Tax Payments for Accounting periods ending between 2002 and 2005.
|
|
|
|
1st Instalment
|
|
|
- The first instalment will be due 31 days before the end of the accounting period but not later than the 21st day of the month in which it is payable (not later than the 28th day of the month in which it is payable for accounting periods ending up to and including 01/7/03).
- The amount of the first instalment will increase from 20% of Preliminary Tax for Accounting Periods ending in 2002 to 40% for 2003, 60% for 2004 and 80% for 2005.
- In the case of a small company (corporation tax liability of less than €50,000 in the previous period - adjusted if not a 12 month accounting period) the payment can be based on the previous periods tax liability (adjusted if period not of equal length) i.e. 20% for Accounting Periods ending in 2002, 40% for 2003, 60% for 2004 and 80% for 2005.
- Where the accounting period is less than one month and one day in length, the first instalment will be due on the last day of the accounting period.

2nd Instalment
|
|
|
- The second instalment will be due within 6 months after the end of the accounting period but not later than the 21st of the month in which it is payable (not later than the 28th day of the month in which it is payable for accounting periods ending up to and including 31/12/02).
- The second instalment should bring total preliminary tax payments for the accounting period up to 90% of the final liability for the accounting period.

Preliminary Tax Payments for Accounting periods ending on or after 1/1/2006 up to 31/3/2008
|
|
|
|
- For accounting periods ending after 2005 only one Preliminary Tax due date will exist. 90% of the final Corporation Tax liability must be paid 31 days before the end of the accounting period but not later than the 21st day of the month in which it is payable.
- In the case of a small company (corporation tax liability of less than €50,000 in the previous period - adjusted if not a 12 month accounting period) the payment can be 100% of the previous periods tax liability (adjusted if period not of equal length).
- Where the accounting period is less than one month and one day in length, the full amount of preliminary tax will be due at the end of the accounting period.

Top-Up Payments
|
|
|
- Because the first instalment of preliminary tax has to be paid before the end of the accounting period, a special provision applies to cater for the situation where additional liabilities, in the form of chargeable gains on disposals, arise in the final month of the accounting period. Where this situation arises a company is permitted to make a further payment of preliminary tax (so called top-up payment). Where such a company correctly pays the first instalment of preliminary tax (but disregarding the gains in the final month), and makes a top up payment one month after the end of the accounting period to bring total payments up to the required level, the company will be regarded as having met its preliminary tax obligations.

Balancing Payment
|
|
|
- Where the Preliminary Tax requirements have been met the Balancing Payment due date for periods ending on or after 1/1/03 up to 31/3/08 will be 9 months after the end of the accounting period but not later than the 21st of the month in which it is payable.
- For periods ending on or before 31/12/02, where the Preliminary Tax requirements have been met, the due date for the Balancing Payment is one month after the notice of assessment but no later than the 28th of the month.

Accounting periods ending on or after 1/4/2008
|
|
|
|
- The payment of the 1st and 2nd (for large companies) instalment of Preliminary Tax and the Balancing Payment will be due no later than the 23rd day of the relevant month where the Payment and the Return has been made through ROS.
